Terms of service

Please review these Terms of Service carefully. These Terms outline the conditions governing the use of whirbtc.net (hereinafter "Whir"). Accessing the Whir service, browsing the website, or sending bitcoin anonymously constitutes your acceptance of and agreement to these Terms. Whir reserves the right to revise these Terms at any time by publishing updated terms on the website. Such modifications become effective on the date they are published.

1. Bitcoin and Whir

1.1 Information on the Bitcoin network

Our Service does not independently send or receive funds; we solely facilitate interaction within the Bitcoin network based on the parameters you provide.

Once the Bitcoin network processes the transaction data you have submitted, that information is relayed to other participants and entities in the Bitcoin network.

The Service cannot be used to cancel Bitcoin transactions or retrieve funds.

1.2 Bitcoin risks

Whir has no authority over and makes no guarantees regarding Bitcoin network security. You acknowledge that operating within the Bitcoin network carries inherent risk. We cannot be held responsible for any loss of funds or profits.

A Bitcoin transaction may stay unconfirmed for a period of time (typically under an hour, but sometimes up to several days). If it remains "unconfirmed," the transaction may never finalize.

1.3 Working arrangements of the Whir service with end customers

The Service arranges a private transfer from a generated deposit address to the destination address. The Service bears no liability for any actions outside the scope described on its website or in these Terms. This covers improper sending of Bitcoin to the service address, duplicate sends, or delays in transaction confirmation.

1.4 Your passwords and security

Whir has no access to the Bitcoin wallets you use to send or receive cryptocurrency. As a result, full responsibility for wallet usage rests with you. If you require guidance regarding any irregularity, feel free to reach out to us.

1.5 The minimum age for the use of the Service

You must be at least 18 years of age, or the minimum age stipulated by applicable local law, in order to use the Whir service.

1.6 Taxes

Tax obligations are your sole responsibility. You are required to determine whether Bitcoin or cryptocurrency activity is subject to tax law in your jurisdiction. All matters concerning tax reporting and payment rest entirely with you. Whir bears no responsibility for such matters and does not offer advice on tax questions that may arise from completed operations.

2. Service use

2.1. Privacy Policy

Please consult our Privacy Policy to gain an understanding of our data handling obligations. By using the service, you consent to the collection and processing of information as outlined in the Privacy Policy.

2.2 Suspension or termination of services

Whir reserves the right to suspend or discontinue access to services at any time, at its sole discretion, with or without cause, and with or without prior notice, assuming no liability whatsoever. For instance, services may be suspended or terminated for the following reasons:

  • an actual or suspected violation of these Terms;
  • use of the Service in such a manner that is conducive to the legal liability of Whir or service malfunction;
  • planned or unplanned maintenance.

  • use of any unauthorized means to access the Whir service or use of any automated process or Service (for example, spider, crawler or periodic caching of information stored or generated by Whir);
  • modification, change, distortion or any other interference in work of the Whir service;
  • disturbing or interference in the operation of servers or networks used by Whir to deliver the services;
  • disabling, overload or degradation of Whir performance (or any other network connected to the Service);
  • use of the Whir service or website for any other purposes other than those expressly provided by these Terms and Privacy Policy;
  • any illegal or fraudulent activity, as well as the use of this Service to legalize illegal income, financing of terrorism, participation in schemes of phishing, forgery or other such falsification or manipulation;
  • spamming, pyramid schemes, or any other activity duplicating unwanted messages should they be commercially oriented or of other nature.

2.4 Service updates

At any time, Whir may perform unplanned work related to the modification, improvement, or updating of the service. We retain the right to add or remove features and to discontinue operation of the Service and website.

2.5 License and restrictions

Whir grants you a personal, non-transferable, non-exclusive license to use the Service as specified by Whir. This license is subject to and limited by the provisions, conditions, and restrictions set forth in these Terms.

Furthermore, this license is strictly for personal, non-commercial purposes. You may not copy, modify, create derivative works from, decompile, or otherwise attempt to extract the source code of the Service or any portion thereof, except as permitted by applicable law or expressly authorized by the Whir platform.

No intellectual property or ownership rights in the Service are conveyed to you under these Terms. Whir retains all rights not expressly granted herein.

3. Users

3.1 Responsibilities

You are:

  • solely responsible for nature, quality, and accuracy of user data transferred to the Service;
  • rapidly view and respond to any notifications and requirements related to user data and operations, including any notices sent to you by our help center.

You won't store or transfer unallowable information, including:

  • illegal, defamatory, menacing, pornographic, offensive or otherwise unacceptable materials of any kind or nature;
  • any materials encouraging illegal actions which can be a criminal offense or violating intellectual property rights, rights for publicity or personal privacy of others;
  • any materials containing or using software viruses or other harmful or harmless computer codes, files, or programs such as trojan horses, worms, bots, or spyware which may harm, endanger or oppress another person, organization, or Whir.

Whir does not allow use of the service if doing so conflicts with the laws applicable in your jurisdiction. This applies not only to use of the service's features but also to activities connected with the Bitcoin network.

As Whir does not gather any personal information, including details about your geographic location, ensuring compliance with local regulations is entirely your own responsibility. Whir accepts no liability in this regard.

4.2 Disclaimer of warranties

YOUR USE OF THIS SERVICE IS AT YOUR SOLE RISK. WHIR PROVIDES THE WEBSITE AND SERVICE ON AN "AS IS," "WITH ALL FAULTS" AND "AS IS NOW" BASIS. WHIR DOES NOT PROVIDE (AND PURPOSELY DISCLAIMS) ALL STATEMENTS OR WARRANTIES OF ANY KIND, IMPLIED, STATUTORY AND OTHER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OF SMOOTH OPERATION OF THE SERVICE AND ABSENCE OF ERRORS OR MALICIOUS COMPONENTS IMPLEMENTED WITHOUT OUR KNOWLEDGE OR CONSENT BY THE THIRD PARTY. WHIR IS NOT LIABLE FOR ANY LOSSES, WHICH EITHER YOU OR THIRD PARTIES SUFFER AS A RESULT OF THE SERVICE USE.

WHIR IS NOT ABLE TO OFFER ANY ASSURANCES OF SATISFACTORY SERVICE QUALITY, ITS FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF ANY RIGHTS.

SOME JURISDICTIONS DO NOT ALLOW MENTIONED EXCLUSIONS. IN SUCH CASE THESE EXCLUSIONS HAVE NO EFFECT ONLY WITHIN LIMITS PROHIBITED BY CURRENT LEGISLATION.

4.3 Limitation of liability

TO THE FULL EXTENT PERMITTED UNDER APPLICABLE LAW, UNDER ANY CIRCUMSTANCES NEITHER WHIR NOR EMPLOYEES, AGENTS, PARTNERS, VENDORS, LICENSORS ARE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DELIBERATE OR OTHER DAMAGE (INCLUDING, WITHOUT LIMITATION, DAMAGE BY LOST PROFIT, REVENUE, REPUTATION) OCCURRED WHEN USING THIS SERVICE.
